YEZ Terms and Conditions

1. Agreement & Acceptance

By purchasing, activating, or using the eSIM product “Yez” (the “Service”), you (the “Customer”, “User” or “you”) agree to these Terms & Conditions. If you do not agree, do not purchase or use the Service.

Your use of the Service constitutes your acceptance of all terms in this Agreement.

2. Definitions

  • eSIM: an embedded / electronic SIM profile delivered and activated digitally, without a physical SIM card.
  • Plan / Package: the prepaid data, voice, and/or text allocation associated with a given eSIM purchase.
  • Activation: the process of installing and enabling the eSIM profile on a compatible device.
  • Validity Period: the time period during which the purchased Plan remains active (after activation or as specified).
  • User Content: any data, content, traffic, or communications sent or received using the Service.

3. Eligibility & Device Requirements

  • You must use a device that supports eSIM technology. The Customer is responsible for verifying device compatibility before purchase.
  • We bear no responsibility if the eSIM does not work due to device incompatibility, network restrictions, or device lock status.

4. Service Description

  • The Service provides access to mobile data, and, where applicable, voice and/or text services as specified in the selected Plan.
  • The Service is delivered via local or partner mobile networks; coverage, speed and availability may vary depending on the region, network conditions, and local regulations.

5. Activation & Use

  • Upon purchase, the Customer must follow the instructions to install and activate the eSIM.
  • The Plan becomes valid once the eSIM is connected to the network and the device is online.
  • The Customer is responsible for any configuration steps needed (e.g., APN settings) to ensure data, voice, or text functionality.
  • The Service may permit tethering / hotspot usage if the Plan and local regulations allow — subject to any limitations communicated at purchase.

6. Validity & Expiry

  • Each Plan has a defined data (and/or voice/text) allocation and a validity period.
  • Unused data or minutes/texts will expire when the validity period ends; no credits, refunds, or carry-over will be given for unused allocations after expiry.

7. Charges, Refunds & Credits

  • The purchase price paid at checkout covers the Plan as described.
  • Refunds or credits are only possible if the eSIM fails to install or there is a persistent service failure due to a fault on our end.
  • To request a refund or credit, the Customer must contact support, report the issue, and cooperate with troubleshooting and verification processes.
  • Refund requests may be subject to a time limit (e.g., within 30 days of purchase or attempted activation).
  • If the Customer uses the eSIM (i.e., activation is successful and data/voice/text is used), no refund or partial refund for unused allocations will be offered.

8. Acceptable Use

As a condition of using the Service, the Customer agrees not to use it (directly or indirectly) for any of the following prohibited behaviors:

  • Illegal activities: transmitting, distributing or storing material in violation of any applicable law or regulation.
  • Malicious activity: hacking, phishing, spreading malware, denial-of-service attacks, or any activity intended to disrupt or degrade networks or other users’ experience.
  • Spam or unsolicited communications: bulk messaging, spam, unsolicited adverts, marketing without consent, or abuse of network resources.
  • Fraud, impersonation, or unauthorized use of identities or accounts.
  • Resale, sharing, or distribution of the Service or eSIM profile to third parties unless explicitly allowed by us.
  • Use that violates local telecom regulations or the policies of the underlying network providers.
  • Use that interferes with the functioning of the Service, networks, or other customers.

We reserve the right to suspend or terminate your Service immediately if you violate these Terms and Conditions or if your activities may cause harm, legal liability, or risk to the Service.

9. Suspension, Termination & Account Closure

  • We may suspend or terminate the Service or your access at any time — with or without notice — if you breach these Terms and Conditions.
  • Upon termination, all rights granted to you cease; any remaining unused data/voice/text allocations are forfeited.
  • Termination does not affect rights or obligations that accrued prior to termination (e.g., outstanding payments, liability for misuse, indemnification).

10. Disclaimer, Limitation of Liability & No Warranty

  • The Service is provided “as is” and “as available,” without warranty of any kind (express or implied), including but not limited to fitness for a particular purpose, reliability, availability, speed, or coverage.
  • We do not guarantee uninterrupted service, full coverage, or compatibility in every location or on every device.
  • To the maximum extent permitted by law, we and our affiliates, partners, and carriers are not liable for any loss, damage, or costs — whether direct, indirect, consequential or incidental — arising from the use or inability to use the Service.
  • In no event shall our liability exceed the amount paid by the Customer for the applicable Plan.

11. Changes to Terms, Plans or Service

  • We reserve the right to modify, suspend, or discontinue the Service (or any part of it), change pricing, data allocations, coverage, or Validity Periods, or update these Terms at any time.
  • We will provide notice of material changes via our website or communication channels where feasible. Continued use of the Service after changes constitutes acceptance of the updated terms.

12. Privacy & Data Protection

  • Use of the Service may involve processing personal data in accordance with our Privacy Policy.
  • By using the Service, the Customer consents to the collection, use, storage and processing of personal data as described in our Privacy Policy (e.g., to deliver connectivity, maintain the Service, respond to support requests).
  • The Customer is responsible for any data transmitted using the Service (content, apps used, files downloaded, etc.).

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of [Country] without regard to conflicts of law principles.

14. Miscellaneous

  • If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
  • Headings are for convenience only and do not affect interpretation.
